These Terms of Use (“Terms”) govern your access to and use of the HopeKey Homes website and services (“Services”). By using the Services, you agree to these Terms. If you do not agree, do not use the Services. We may change these Terms; the “Last updated” date will reflect revisions.
1. The Services
HopeKey Homes provides tools and content related to rent-to-own and housing programs, and may include landlord-facing features such as property records, expense tracking, document storage, and optional exports (for example, merged PDFs). Features and availability may change without notice.
2. Not professional advice
The Services are not legal, tax, accounting, investment, or insurance advice. Nothing on the site or in the app replaces advice from a qualified professional tailored to your situation. In-app calculations, summaries, “missing proof” messages, and generated PDF packs are convenience tools for your own records only. They are not reviewed or endorsed by the Canada Revenue Agency or any government body. You are solely responsible for the accuracy of information you enter, for maintaining official records as required by law, and for any filings or decisions you make.
3. Your account and accuracy
You agree to provide accurate registration information and to keep your credentials secure. You are responsible for activity under your account. You must not misuse the Services, attempt unauthorized access, or upload unlawful or malicious content.
4. Content you provide
You retain ownership of content you upload. You grant us a licence to host, process, and display that content as needed to provide the Services (including generating exports you request). You represent that you have the rights necessary to upload content about third parties (such as tenants) where applicable, and that your use complies with privacy law.
5. Intellectual property
The Services, branding, and original materials are owned by HopeKey Homes or its licensors and are protected by intellectual property laws. You may not copy or exploit them except as allowed by these Terms or with our written permission.
6. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF HARMFUL COMPONENTS.
7. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOPEKEY HOMES AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES OR INABILITY TO USE THEM, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED CANADIAN DOLLARS (CAD $100), EXCEPT WHERE LIABILITY CANNOT BE EXCLUDED BY LAW (FOR EXAMPLE, CERTAIN CONSUMER PROTECTION RIGHTS).
8. Indemnity
You agree to indemnify and hold harmless HopeKey Homes from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Services, your content, or your violation of these Terms or applicable law, except to the extent caused by our gross negligence or wilful misconduct.
9. Governing law
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. You agree to the non-exclusive jurisdiction of the courts located in Alberta, subject to mandatory consumer protections where they apply.
